Please read these Terms carefully before booking a travel package with Luxytrix Travel. By proceeding with a booking, you acknowledge that you have read and agreed to these Terms.
These Terms and Conditions ("Terms") govern all bookings made with Luxytrix Travel Pvt. Ltd., whether through our website, by phone, WhatsApp, email, or in-person at our office. These Terms apply to all travellers named in a booking.
1. Acceptance of Terms
By accessing or using the Luxytrix Travel website (luxytrix.com) or by booking any travel services with us, you agree to be bound by these Terms and Conditions ('Terms'), our Privacy Policy, and our Refund Policy. If you do not agree to these Terms, please do not use our services.
These Terms constitute a legally binding agreement between you ('Customer', 'Client', 'you') and Luxytrix Travel Pvt. Ltd. ('Luxytrix', 'Company', 'we', 'us'). We reserve the right to update these Terms at any time. Continued use of our services after changes are published constitutes acceptance of the updated Terms.
2. Booking & Confirmation
Booking Process: A booking is considered confirmed only upon receipt of the booking deposit (minimum 20% of total package value, unless otherwise specified) and a written confirmation from Luxytrix Travel via email or WhatsApp.
Pricing: All prices quoted are in Indian Rupees (INR) and are valid for the duration specified in the quotation. Prices may change due to fluctuations in airfare, hotel rates, currency exchange rates, or government taxes. Once a booking is confirmed and deposit received, the price is locked.
Payment Schedule: The booking deposit is due at the time of confirmation. The balance payment is due as specified in your booking confirmation (typically 30 days before departure, or as agreed). Full payment may be required for last-minute bookings.
Package Changes: Changes to confirmed bookings (dates, hotels, activities) are subject to availability and may attract amendment fees. Amendment requests must be made in writing.
3. Inclusions & Exclusions
What's Included: The package inclusions are clearly specified in each package description and booking confirmation. Standard inclusions may include hotel accommodation, specified meals, airport transfers, and guided sightseeing as detailed.
What's Excluded: Unless explicitly stated, packages do not include: international or domestic airfare, visa fees, travel insurance, personal expenses (tips, laundry, phone calls), meals not mentioned, optional activities, and any services not specifically itemised in the booking confirmation.
Itinerary Changes: Luxytrix reserves the right to modify itineraries due to force majeure events, safety concerns, weather conditions, or operational reasons. In such cases, we will substitute with services of equal or higher value wherever possible.
4. Travel Documents & Visa
It is the sole responsibility of the traveller to ensure they possess valid travel documents (passport, visa, health certificates) required for all destinations on the itinerary.
For international tours, your passport must be valid for at least 6 months beyond your return date. Luxytrix provides visa assistance but cannot guarantee visa approval — visa decisions rest solely with the respective embassy or consulate.
Luxytrix will not be held liable for any costs, losses, or damages arising from a traveller's failure to hold valid travel documents. Any costs incurred due to document issues (rebooking, repatriation) are the traveller's sole responsibility.
5. Health & Safety
Travellers are responsible for ensuring they are physically fit and medically capable of undertaking the booked travel activities. Certain adventure activities (trekking, scuba diving, rafting) have specific fitness requirements detailed in the package description.
Luxytrix strongly recommends purchasing comprehensive travel insurance covering medical emergencies, trip cancellation, baggage loss, and flight delays. We can arrange travel insurance as an add-on to any package.
Travellers with known medical conditions must disclose these to Luxytrix at the time of booking. We reserve the right to decline bookings for travellers whose medical condition may pose a risk to themselves or the group.
6. Liability Limitations
Luxytrix Travel acts as an agent for hotels, airlines, transport companies, and tour operators. While we take every reasonable step to ensure quality and safety, we are not liable for:
• Personal injury, death, property damage, or loss arising from the acts or omissions of third-party service providers.
• Delays, cancellations, or changes caused by airlines, hotels, or ground operators.
• Loss or damage to personal belongings, travel documents, or money.
• Events of force majeure including natural disasters, pandemics, political unrest, strikes, or government actions.
• Any indirect, consequential, or punitive damages arising from your use of our services.
Our maximum liability to any customer for any claim shall not exceed the total amount paid for the specific travel package that is the subject of the claim.
7. Cancellation Policy
Please refer to our separate Refund Policy (/refund-policy) for full details of our cancellation and refund terms. In summary:
• Cancellations 30+ days before departure: Full refund of package cost minus non-refundable components (airline tickets, visa fees, etc.).
• Cancellations 15–29 days before departure: 25% cancellation charge applies.
• Cancellations 7–14 days before departure: 50% cancellation charge applies.
• Cancellations less than 7 days before departure: 75% cancellation charge applies.
• No-shows or cancellations on day of departure: No refund.
All cancellation requests must be submitted in writing (email or WhatsApp) to be valid.
8. Force Majeure
Neither Luxytrix nor the traveller shall be liable for failure to perform obligations under this agreement due to events beyond reasonable control, including but not limited to: natural disasters (earthquakes, floods, volcanic eruptions), war or political unrest, terrorist attacks, pandemic or epidemic outbreaks, government travel restrictions, airline or transportation strikes, and Acts of God.
In force majeure situations, Luxytrix will make every reasonable effort to provide alternative arrangements or rescheduling options. Refunds in force majeure situations will be governed by the policies of individual airlines, hotels, and service providers involved.
9. Customer Conduct
Luxytrix reserves the right to terminate the travel arrangements of any customer whose conduct is deemed disruptive, dangerous, illegal, or offensive to other guests, staff, or local communities — without any refund obligation.
Customers are expected to behave respectfully toward local customs, religious practices, and environmental conservation guidelines at all destinations. Damage to property caused by customers will be charged to the customer's account.
10. Intellectual Property
All content on luxytrix.com — including text, images, graphics, logos, and package descriptions — is the intellectual property of Luxytrix Travel Pvt. Ltd. and is protected under Indian copyright law.
You may not reproduce, distribute, modify, or use our content for commercial purposes without prior written consent from Luxytrix Travel.
11. Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from or related to these Terms or Luxytrix's services shall be subject to the exclusive jurisdiction of the courts of Gautam Buddh Nagar (Noida), Uttar Pradesh, India.
We encourage customers to first attempt to resolve any dispute through direct communication with our Customer Relations team at info@luxytrix.com. Most issues can be resolved quickly and amicably without formal legal proceedings.
